2. Purpose of the processing
With this data protection notice, we therefore inform you about the type, scope and purpose of the collection and use of personal data. The NOB Nano Optics Berlin GmbH website can be used without providing personal data.
Insofar as personal data (such as name, address or e-mail address) is collected, this is done exclusively on a voluntary basis within the meaning of Art. 6 para. 1 lit. a GDPR.
The protection and confidentiality of your data is very important to NOB Nano Optics Berlin GmbH. We therefore collect, process and use your personal data exclusively in compliance with the applicable data protection laws of the Federal Republic of Germany and the data protection regulations of the European Union.
We reserve the right to amend this data protection notice from time to time at our own discretion. In this respect, the currently published data protection notice applies to each visit to our website.
2.1 Personal data
Personal data is individual information about the personal or factual circumstances of an identified or identifiable natural person. This includes information such as name, address, telephone/fax number and e-mail address.
2.2 Collection, processing and use of personal data
Personal data is only collected if you provide it to us voluntarily, for example in the course of enquiries, e-mails or contact forms. In order to process your enquiry or request for quotation smoothly and for any necessary follow-up questions, we require the following mandatory information about you and the purpose of the contact:
Contact form (https://www.nanooptics-berlin.com):
- Name (mandatory field)
- E-mail (mandatory field)
- Message (mandatory field)
The data entered in the contact form will not be stored in our company. This personal data is used exclusively for communication with you within NOB Nano Optics Berlin GmbH. Under no circumstances will it be passed on to third parties through sale or rental. NOB Nano Optics Berlin GmbH will only pass on personal data to third parties if there is an enforceable official or court order.
3. Security
We take all necessary technical and organisational security measures to protect your personal data from loss and misuse. For example, your data is stored in a secure operating environment that is not accessible to unauthorised persons. We would like to point out that Internet-based data transmission is subject to security vulnerabilities, making complete protection against access by third parties impossible.
4. Cookies and analysis tools
Our website does not use cookies, nor do we use analysis tools such as Google Analytics or similar.
5. Data protection information for online meetings, telephone conferences and webinars via ‘Zoom’ or ‘Teams’)
We use the tools ‘Zoom’ or ‘Teams’ to conduct telephone conferences, online meetings, video conferences and/or webinars (hereinafter: ‘online meetings’). ‘Zoom’ is a service provided by Zoom Video Communications, Inc. based in the USA. Teams is a Microsoft product, also based in the USA.
Note: If you access the online meeting website, the provider of ‘Zoom’ or ‘Teams’ is responsible for data processing. However, you only need to access the website to use ‘Zoom’ or ‘Teams’ in order to download the software for using ‘Zoom’ or ‘Teams’. You can also use the online meetings if you enter the relevant meeting ID and any other access data for the meeting directly in the app. If you do not want to or cannot use the apps, the basic functions can also be used via a browser version.
Various types of data are processed when using online meetings. The scope of the data also depends on the data you provide before or when participating in an ‘online meeting’. The following personal data is processed:
- User details: first name, surname, telephone (optional), e-mail address, password (if ‘single sign-on’ is not used), profile picture (optional),
- Department (optional)
- Meeting metadata: Topic, description (optional), participant IP addresses, device/hardware information.
- For recordings (optional): MP4 file of all video, audio and presentation recordings, M4A file of all audio recordings, text file of the online meeting chat.
- When dialling in by telephone: details of the incoming and outgoing telephone number, country name, start and end time. If necessary, further connection data such as the IP address of the device can be saved.
- Text, audio and video data: You may have the opportunity to use the chat, question or survey functions in an ‘online meeting’. In this respect, the text entries you make are processed in order to display them in the ‘online meeting’ and, if necessary, to log them. In order to enable the display of video and the playback of audio, the data from the microphone of your end device and from any video camera of the end device will be processed accordingly for the duration of the meeting. You can switch off or mute the camera or microphone yourself at any time via the applications.
To take part in an ‘online meeting’ or to enter the ‘meeting room’, you must at least provide information about your name.
We use ‘Zoom’ or ‘Teams’ to conduct online meetings. If we want to record ‘online meetings’, we will inform you transparently in advance and - if necessary - ask for your consent. The fact of the recording will also be displayed to you in the apps. If it is necessary for the purposes of logging the results of an online meeting, we will log the chat content. However, this will not usually be the case. If you are registered with ‘Zoom’ as a user, reports on ‘online meetings’ (meeting metadata, telephone dialling data, questions and answers in webinars, survey function in webinars) can be stored for up to one month at ‘Zoom’.
Automated decision-making within the meaning of Art. 22 GDPR is not used.
Insofar as personal data of employees is processed, Section 26 BDSG is the legal basis for data processing. If, in connection with the use of ‘online meetings’, personal data is not required for the establishment, implementation or termination of the employment relationship, but is nevertheless an elementary component of the use of ‘online meetings’, Art. 6 para. 1 lit. f) GDPR is the legal basis for data processing. In these cases, we are interested in the effective organisation of online meetings. Otherwise, the legal basis for data processing when organising ‘online meetings’ is Art. 6 para. 1 lit. b) GDPR, insofar as the meetings are held within the framework of contractual relationships. If there is no contractual relationship, the legal basis is Art. 6 para. 1 lit. f) GDPR. Here too, we have an interest in the effective organisation of online meetings.
Personal data that is processed in connection with participation in ‘online meetings’ will not be passed on to third parties unless it is intended to be passed on. Please note that content from ‘online meetings’, as with face-to-face meetings, is often used to communicate information with customers, interested parties or third parties and is therefore intended to be passed on.
Other recipients: The provider of ‘Zoom’ necessarily receives knowledge of the above-mentioned data, insofar as this is provided for in our order processing contract with ‘Zoom’.
‘Zoom’ and “Teams” are services provided by providers from the USA. Personal data is therefore also processed in a third country.
An adequate level of data protection is guaranteed on the one hand by the ‘Privacy Shield’ certification of Zoom Video Communications, Inc. and on the other hand by the conclusion of the so-called EU standard contractual clauses.
6. Server logging
All access to this website is logged by the Internet server. This data is only analysed for statistical purposes and then deleted after 7 days. It is not used for any other purpose or passed on to third parties.
7. Duration of storage
After complete processing of the respective business transactions, the data will initially be stored for the duration of the warranty period, then in accordance with statutory retention periods, in particular tax and commercial law, and then deleted after expiry of the period, unless you have consented to further processing and use.
8. Right to information, blocking, rectification and erasure
If the legal requirements are met, you have the following rights under Art. 15 to 20 GDPR: right of access, right to rectification, right to erasure, right to restriction of processing, right to data portability. You can request information about your data stored by us at any time. You will not incur any costs as a result of such a request. It is not necessary to give reasons for this. You can also block, correct or delete data collected by us at any time and object to the collection and storage of data for the purpose of optimising our website. It is also possible to withdraw your consent to the collection and use of data at any time without giving reasons. To do so, please use the contact details provided in the legal notice and contact us.
10. Right to lodge a complaint with the supervisory authority
In accordance with Art. 77 GDPR, you have the right to lodge a complaint with the supervisory authority if you believe that your personal data is being processed unlawfully. The supervisory authority responsible for us is the Berlin Commissioner for Data Protection and Freedom of Information, Alt-Moabit 59-61, 10555 Berlin.
11. Amendment of the data protection information
We will revise this data protection notice in the event of changes to data processing or other occasions that make this necessary. The current version can always be found on this website.
